Qian Qian

Attorney Qian’s practice focuses on major commercial dispute resolution and arbitration, with long-term involvement in handling significant commercial dispute resolution cases. She has represented numerous financial institutions, listed companies, large state-owned enterprise groups, and private enterprise groups in hundreds of various litigation matters, possessing extensive courtroom representation experience.

Attorney Qian specializes in transaction disputes and various emerging financial dispute cases. She represented the nation’s first financial test case at the Shanghai Financial Court, involving central counterparty centralized clearing defaults for financial derivatives. Both the regulatory framework and the dispute itself were highly innovative and groundbreaking. Attorney Qian excelled in the preparatory work, issue梳理, and court proceedings, earning praise from all parties involved. The case was awarded the Second Prize of the Shanghai Financial Innovation Achievement Award and the inaugural Excellent Case Award of the Shanghai Lawyers Association. In another case, she represented a resource group company in a contract dispute with a Hong Kong company, which was selected as a Supreme People’s Court Gazette case. She also represented a listed company in a securities misrepresentation case, which was chosen as a typical securities dispute case by the Guangdong courts.

First National Financial Test Case: Participated in the nation's inaugural financial test case heard by the Shanghai Financial Court, representing the applicants (including Société Générale, Bank of Communications, Shanghai Pudong Development Bank, and Industrial Bank) in handling a central counterparty financial derivatives default disposal dispute with the respondent, Shanghai Clearing House.

Gazette Case: Represented the actual controller of a listed company and its subsidiary in a retrial case involving a service contract dispute with a Hong Kong company. Successfully persuaded the Supreme People's Court to overturn the original judgment during the retrial stage, dismissing the ruling that required the listed company's subsidiary to bear joint and several liability.

Guangdong Court Securities Typical Case: Represented a listed company and its executives in a misrepresentation dispute with investors, achieving a favorable verdict and avoiding potential compensation claims worth hundreds of millions for the company. The case involved legal issues such as the application of the "safe harbor" rule for forward-looking statements.

Represented an asset management company in a bond dispute with an energy company, with the amount involved reaching 2 billion RMB. Subsequently, participated in and facilitated the restructuring proceedings of the entity, which constituted the first listed company restructuring case in the province.

Represented a corporate group in handling import-export and cross-border share pledge guarantee dispute cases. Creatively adopted an alternative litigation strategy to expand the scope of defendants and achieve full debt recovery. The dispute amount reached 1.7 billion RMB, making it the case with the largest claim amount accepted by the Shanghai High People's Court in 2010.

Represented a provincial state-owned bank as the defendant in another contract dispute case with an insurance company, with the amount involved reaching 1.6 billion RMB. This was the largest litigation case involving a state-owned bank in the province.

Represented a state-owned bank in a bankruptcy reorganization dispute with a company, with the amount involved reaching 1.6 billion RMB. This was the bankruptcy case with the largest claim amount handled by the Shanghai branch of the state-owned bank.

Represented a trust company in an arbitration case involving a fund share repurchase dispute with a local state-owned enterprise, recovering an amount exceeding 1.2 billion RMB.

Represented a joint-stock bank in a financial loan dispute case with a well-known steel group company, with the amount involved reaching 700 million RMB. During the enforcement objection phase, through thorough investigation, successfully demonstrated numerous疑点 in the objector's claims, compelling them to withdraw the objection and safeguarding the full interests of the creditor.

Represented a fund company in a bond dispute with a listed company, with the amount involved reaching 200 million RMB. This case occurred during the early stages of bond dispute litigation and involved novel issues such as whether bondholders could file lawsuits individually. Successfully persuaded the court to accept the bondholders' lawsuit. The representative was invited to participate in and speak at a thematic seminar organized by the Securities Law Association due to this case.
