Zhu Siheng

Attorney Zhu’s primary practice focuses on civil and commercial matters, particularly in the resolution of major commercial disputes in the areas of contracts, finance, corporate law, and bankruptcy. Attorney Zhu has handled a significant number of litigation cases, including those at the Supreme People’s Court and various intermediate and higher-level courts, with a total claim amount exceeding tens of billions of RMB. He has provided litigation, arbitration, and enforcement services to numerous well-known domestic and international enterprises in disputes involving commercial contracts, torts, intellectual property, and bankruptcy-related litigation.

Currently, Attorney Zhu serves as a member of the Bankruptcy Derivative Litigation Business Research Committee and the Party Building and Social Responsibility Committee of the Shanghai Association of Bankruptcy Administrators. He is also a lecturer on commercial litigation practice at Fudan University and Shanghai Jiao Tong University.

[Supreme Court Retrial Reversal] Represented a foreign bank in a property right confirmation lawsuit against a Chinese bank. The Supreme Court ultimately overturned the original judgment and ruled in favor of all claims made by the foreign bank.

Represented an investment company in filing a reconsideration petition regarding the consolidated bankruptcy reorganization of a real estate company. Through professional legal argumentation, successfully prompted the first-instance court to correct its erroneous ruling via trial supervision procedures.

Represented a trust company in a corporate document and license return dispute with minority shareholders of a company and the bankruptcy administrator of the majority shareholder. The trust company's supervisory seals had been forcibly removed by the opposing party through unlawful means. Acted on behalf of the trust company to reclaim the co-management rights over seals, documents, and licenses, achieving the objective of continued supervision.

Represented an asset management company in a bond dispute with an energy company, with the amount involved reaching 2 billion RMB. Subsequently participated in and facilitated the restructuring proceedings of the entity, marking the first listed company restructuring case in the province.

Represented an insurance capital company in a bond misrepresentation case against intermediary institutions, marking the first dispute in the province involving intermediary liability for bond misrepresentation.

Represented an entertainment company in a series of copyright and unfair competition disputes against an online platform. The case involved the platform's safe harbor defense, and high compensation was awarded for infringement of works under the same name.

Represented a fund company in a bond dispute with a listed company, with the amount involved reaching 200 million RMB. This case occurred during the early stages of bond dispute litigation and involved novel issues such as whether bondholders could file lawsuits individually. Successfully persuaded the court to accept the bondholders' lawsuit. The representative was invited to participate in and speak at a thematic seminar organized by the Securities Law Association due to this case.

Represented a trust company and a fund company in a bankruptcy creditor's rights case. Through active communication and negotiation with the court and the bankruptcy administrator, successfully completed the first large-scale fund distribution under tight constraints within three months.
