Litigation tips

Unique litigation tips are the magic weapons that help us win a lot of complicated cases. Once some of these tips disclosed (e.g. the visualization of litigation), it has caused a strong repercussion among peers and is widely used in the whole field. But one will just have a superficial knowledge of it without accumulation for several decades.

Persuaded under subconscious

‘Visualization’, the product of ten years of our work and to make the unique esoterica, immediately detonated the Chinese lawyers’ circle after a little ‘show’ in front of the peers.
More than 15,000 lawyers and corporate counsels accepted our visualization training courses nationwide.

This is a text introduction about a kind of fruit:

‘This fruit, sour and bitter, which is inappropriate to eat too much, is the fruit of rutaceae plants and it’s one of the four most famous fruits in the world. The plant belongs to the evergreen trees, with thorny branches, oblong leaves, long petioles and flourish wings. Its white flowers with the anti-roll resistance are solitary, tufted or in racemes. Its seeds with the ribbed surface are oblong or oval. Its fruit can be peeled to eat flesh, and its flesh can also be used as additions to other foods. The fruit is native to the southern China and the southern provinces are distributed. Among them, planting in Jiangxi, Sichuan, Guangdong, Taiwan and other provinces are more concentrated. The fruit was introduced into Europe from China in the early fifteenth century, the late fifteenth century into the Americas.’
Now the question is: What is this fruit? Some people guess kiwifruit, some people agree with peaches, while others say tomatoes.
Nobody succeeded in answering the right answer. We will use ‘Visualization’ to tell you the truth,

What you see is the fact

If there’s only a paragraph of text or a piece of sound, you will be skeptical: Is that true?
But if it is a picture, you will believe what you see. This is called ‘Seeing is believing.’
How should we use these principles to achieve strong persuasion in the court?

In a retrial case over an equity dispute represented by our firm, the target company was involved in multiple rounds of complex risk investments. Some of them were explicit, and some were anonymous. In addition, company valuations were not the same, while there are great discrepancies between the industrial and commercial registration information and the actual equity investment behavior. Thus, resulting in the confusing equity situation which cannot be ascertained easily. Before our intervention, the client, as the investment subjects, lost both the trial of first instance and trial of second instance. After the procuratorate protest, the case was sent back to the court of first instance. Again the client lost both the first instance and the second instance. After our intervention, in order to clarify the equity change, after discussions through the night, we showed the process of the change of equity, as well as the parties’ equity position and trading patterns through visualization. And eventually win the case in the fifth judgment.
